Import of waste paper is free as per policy. But as per Hazardous Material ( Management, Handling and Transboundary Movement) Rules, 2008 notified by Ministry of Environment & Forests, import of waste paper can be made only subject to actual user condition with permission from MOEF and a licence from DGFT. The contradiction between ITC and the said rules was addressed temporarily by DGFT by issuing a circular on 1-4-2009 stating that till the matter is suitably resolved, RA may grant import licence.
now, pre-shipment certificate is stated as required for NOC from Environment Ministry for such goods shipped on or after 25-4-2009. DGFT has 'instructed' Customs Officers to carry out more physical checking of such imports. It seems Commerce Ministry is literally treating Revenue Department as subordinate office.-DGFT Policy Circular no. 82 (RE-2008)/2004-09, dated 28-4-2009. |
